The constitutional mandate is that the State shall secure that the operation of the legal system promotes justice. Part III makes provision for equality before law, equal justice and free legal aid. Article 39A mandates that the State shall provide free legal aid by suitable legislation or schemes. To implement this constitutional objective, Legal Services Act was enacted in 1987 and was notified in 1995.
The district judiciary was established at Udalguri in November 2011 and the District Legal Services Authority Udalguri came into existence in May 2014. After creation, DLSA Udalguri focused its attention in providing counsel at State expense, and bearing all incidental expense in connection with the case of a person falling under section 12 L.S. Act, 1987. The person to whom legal aid is provided is not called upon to spend anything on the litigation once it is supported by the DLSA.
The Next Stage:- In a country like ours where a large chunk of the populace is still grappling with illiteracy and poverty, it cannot be expected that this segment of the citizenry would be aware of their rights. Hence, following the footsteps of ASLSA, we have now formulated plan and programme to reach out and respond to the poorest of the poor. We have taken it as a mission so that entitled persons do get the benefit of the beneficial schemes formulated by the executive. Legal service would be provided not only in the courts but also in public offices which deals with the rights –socio or economic of the citizenry.
